George Zimmerman Suing NBC Over Edited 911 Tape

George Zimmerman’s attorney on Thursday confirmed his client is considering a defamation lawsuit against NBC over the misleading editing of a recording that he said made his client “appear he is a racist.”

In a statement Thursday, Zimmerman’s lawyer Mark O’Mara said NBC’s editing version of his client’s call to Sanford Police was “outrageous.”

“Due in large part to NBC’s actions, George has had to live in hiding, in fear for his life,” he wrote.

The audio, which aired March 27 on the “Today” show and in a report by an NBC-owned affiliate days earlier, made it sound as if Zimmerman volunteered to police that 17-year-old Trayvon Martin was black in the call he made before the Feb. 26 shooting.

In the NBC-edited audio, Zimmerman says of Trayvon, “This guy looks like he’s up to no good. He looks black.”

But those two sentences are not back-to-back in the original audio. In between, a police dispatcher asked Zimmerman about Trayvon’s race.

Sorry George, but we didn’t need those tapes to make us think you were a racist.

NBC since apologized, and three employees were let go, according to reports. The network declined to comment on Thursday.

Jon Kaney, an experienced media lawyer and general counsel to Florida’s First Amendment Foundation, said there are several elements of defamation that need to be addressed in Zimmerman’s claim.

First of which is:

The most basic: Is the edited audio defamatory? That’s subject to interpretation, Kaney said.

“[Zimmerman] begins with an argument that’s based on an implication. NBC did not say he is a racist,”

Secondly:

Zimmerman went into hiding soon after the shooting, weeks before the “Today” report. In the interrim, the case sparked international outrage, focused largely on Zimmerman.

Zimmerman’s high profile raises another key issue: Whether he was a public figure in the eyes of the law at the time of the alleged defamation.

If so, Kaney said, he’d have to show NBC “knew the statement was falsely made, or acted with reckless disregard for its truth or falsity.”

Tompkins says that although networks settle many defamation cases out of court, Zimmerman’s is not likely to be one of them.

George Zimmerman Wants Trayvon Martin’s School Records To Prove He Was A Bad Kid

This man and his legal team are desperate for a defense…

Alleged Trayvon Martin shooter George Zimmerman wants to use the slain teen’s school records as part of his defense.

Zimmerman’s attorney said Friday he has sent subpoenas to the schools the 17-year-old Martin attended in the Miami area. The subpoenas request disciplinary notices, suspensions and tardiness records among other things.

Martin was suspended by Miami-Dade County schools because traces of marijuana were found in a plastic baggie in his book bag. He was serving the suspension when he was shot Feb. 26 by Zimmerman.

Zimmerman is charged with second-degree murder. He is pleading not guilty, claiming self-defense.

What in the world does his school record, whether it be exemplary or not, have anything to do with the night he was shot?? Murder an innocent kid and then try to discredit him in death. The definition of desperate.

George Zimmerman, accused of second-degree murder in the shooting death of 17-year-old Trayvon Martin, told a television interviewer Wednesday that he would not have changed the circumstances leading up to the shooting and that he viewed the entire incident as “God’s plan.” At the very end of the interview, however, after commercial breaks and with his lawyer by his side, Zimmerman asked “to readdress on whether I’d do anything differently.”

“I do wish that there was something, anything I could have done that would have put me in the position that I wouldn’t have to take his life,” Zimmerman told Sean Hannity on Fox News Channel. “I’m sorry that this happened. I hate to think that because of this incident, because of my actions, that it’s polarized and divided America.”

Earlier in the interview, when Hannity asked Zimmerman if he regretted the specific actions of carrying a gun or getting out of his car to follow Martin that February night, the neighborhood watchman said that he didn’t. “I feel that it was all God’s plan, and for me to second guess it or judge it,” he said, trailing off. Asked, “Is there anything you might do differently?” Zimmerman said, “No, sir.”

“Zimmerman said that he does not regret getting out of his vehicle, he does not regret following Trayvon, in fact he does not regret anything that he did that night,” the family said in a statement released through an attorney, Ben Crump. “He wouldn’t do anything different and he concluded it was God’s plan.” “We must worship a different God,” added Tracy Martin, Trayvon Martin’s father, “because there is no way that my God would have wanted George Zimmerman to kill my teenage son.”

Zimmerman has said that he shot Martin after Martin knocked him down, banged his head on the pavement and threatened his life, and he believed Martin was going for his handgun. He repeated his claim to Hannity. He said he was particularly upset by the racial aspects of the case and media coverage. “I’m not a racist and I’m not a murderer,” he said.

Zimmerman said he grew suspicious of Martin after spotting the black teen in a hoodie while on an evening errand for groceries. He said Martin was moving between houses in the rain and didn’t look like a resident or a fitness enthusiast out for a run. He believed Martin spotted him and made movements toward his waistband, as if to suggest that he had a weapon, he told Hannity.

“I was on the phone [with a police dispatcher] but I was certain I could see him saying something to me and his demeanor was confrontational,” Zimmerman said. Zimmerman told Hannity he’d like to have the opportunity to apologize to Martin’s family. “I would tell them that, again, I’m sorry,” he said.

“My wife and I don’t have any children,” he said. “I have nephews that I love more than life. I love them more than myself. And I know when they were born, it was a different unique bond and love that I have with them. And I love my children even though that they aren’t born yet. “I am sorry that they buried their child,” he added. “I can’t imagine what it must feel like. And I pray for them daily.”

George Zimmerman’s Defense Team Requests A New Trial Judge

Former self-appointed neighborhood watchman George Zimmerman is now requesting a new judge be appointed to handle his murder trial.

George Zimmerman, accused of murdering 17-year-old Trayvon Martin, filed a motion on Friday to disqualify the judge that will preside over his case, citing his fear that he will not be given a fair trial.

Zimmerman, via his attorney, Mark O’Mara, filed the 17-page document with the Seminole County Circuit Court. The motion is a response to Judge Kenneth Lester’s July 5 order that set $1 million bail for Zimmerman and claimed that Zimmerman had “flaunted the system” and practiced “deception upon the court.”

It was the second time Lester granted Zimmerman bail. Lester revoked a previous $150,000 bail in April after prosecutors presented evidence that Zimmerman and his wife misled the court about how much money they had available by speaking in code on phone calls. Prosecutors added that Zimmerman initially lied about the existence of a second passport.

O’Mara recently tried to appeal to the judge that Zimmerman was confused and fearful back in March when the alleged deception occurred. In a second bond hearing in June, O’Mara reiterated that Zimmerman had voluntarily turned himself in to the court and now was completely open regarding his financial ability.

Lester, however, in that July 5 bail order, remained skeptical of Zimmerman’s motives and expressed irritation at being lied to. He accused Zimmerman of manipulating the court and even suggested that if Zimmerman had the opportunity he would have fled prosecution.

In Friday’s motion, O’Mara wrote that Lester’s order was indicative of a bias against Zimmerman, saying that the judge’s statements were “disingenuous, self-serving manipulations.”

First you want out of jail, now you want a new judge. This dude sure has a lot of “requests” for a murderer who’s out on bail. What’s next? Smh.

FBI May Charge George Zimmerman With Hate Crime, Could Face The Death Penalty

Justice is going to get you George.

The State of Florida has charged George Zimmerman with murdering Trayvon Martin. But that might not be the end of his legal problems:

According to WFTV, an affliate of ABC in Orlando, Zimmerman may soon be charged with a hate crime by the FBI:

WFTV has learned charges against George Zimmerman could be getting more serious. State prosecutors said Zimmerman, a neighborhood watchman, profiled and stalked 17-year-old Trayvon Martin before killing him, so the FBI is now looking into charging him with a hate crime. [...]

FBI investigators are actively questioning witnesses in the retreat at the Twin Lakes neighborhood, seeking evidence for a possible federal hate crime charge.

WFTV notes that “if Zimmerman is charged and found guilty of a federal hate crime involving murder, he could face the death penalty.” FBI officials confirm to ABC News that the investigation is ongoing but say the “hammer won’t be dropped” anytime soon.

Most of the evidence against Zimmerman has yet to be disclosed. Late yesterday, Florida prosecution delivered 67 CDs of evidence against Zimmerman to his attorney. Under Florida law, most of it should be available to the public soon.

Some people believe if Zimmerman is found guilty, life in prison seems right. But the death penalty only magnifies heinous crimes by killing again. Do you think the FBI is justified in convicting Zimmerman of a hate crime and would the death penalty be the right sentence for him?

Trayvon Martin Shooting Range Targets Sold Out In Two Days???

This is just disgusting. Another day another dollar for the hatemongers trying to profit off Trayvon’s death.

An anonymous retailer is trying to make money off the Trayvon Martin controversy.

Someone is selling online shooting targets displaying the likeness of the deceased 17-year-old.

There’s no face inside the hoodie, but the bag of Skittles and the bottle of iced tea makes it clear the paper target designed for shooting practice is supposed to be Trayvon Martin. For $8 plus $7.50, sharpshooters have been able to buy a 10 pack of the targets online.

In Sanford, where George Zimmerman shot and killed Trayvon Martin, people are horrified.

According to this advertisement which had been posted on a popular firearms auction site, the sellers say they support Zimmerman and believe he is innocent and that he shot a thug.

“This is the highest level of disgust, and, I don’t know, the lowest level of civility,” said Zimmerman’s attorney, Mark O’Mara.

O’Mara says he worries how Trayvon Martin’s parents will react to this, and he’s concerned it will enflame the community even further – hurting his client.

“It’s this type of hatred – because that’s what this is, its hate-mongering – that’s going to make it more difficult to try this case,” O’Mara said.

It is still unclear who is making these targets, but in a lengthy email exchange, the seller tells wrote “my main motivation was to make money off the controversy.”

The seller would not disclose how many targets have been made, but says the response is overwhelming. The seller said he sold out of the targets in two days.

“I hope there’s a crime that we can charge that person who made that with. I’m not sure what it is, but we need to come up with one, because that’s disgusting,” O’Mara said.

The online advertisements for the targets have been taken down as of Friday.

SMH. This is a damn shame but after we read about how much money Zimmerman’s been caking for his defense online we can’t say we’re surprised at the number of hatemongers out there.

No grand jury for George Zimmerman: What does it mean?

The Florida prosecutor investigating Trayvon Martin’s shooting death sets the nation abuzz by nixing a grand jury hearing the day before it was to convene

So much for trial by jury. Angela Corey, the Florida special prosecutor handling the Trayvon Martin case, had planned a grand jury hearing for Tuesday to decide whether to charge neighborhood watchman George Zimmerman in the shooting death of the unarmed 17-year-old. But on Monday, she changed her mind — just a day before the hearing. By doing so, Corey effectively crowned herself as the only person who will decide whether to charge Zimmerman, who claims he acted in self-defense. What impact will this have on the polarizing investigation? Here’s what you should know:

Why was the prosecutor allowed to skip the grand jury?
Only in the instance of first-degree murder cases does Florida law require that a grand jury decide whether charges should be filed. Corey has a reputation for avoiding grand juries unless she mustconvene one, and Martin’s shooting doesn’t qualify as a first-degree murder since it apparently wasn’t premeditated. The law simply doesn’t require a grand jury.

Is Zimmerman less likely to be charged now?
Many analysts believe Zimmerman is now more likely to be charged. Corey “may have feared that a grand jury would have refused to indict based on the evidence,” says Doug Mataconis at Outside the Beltway, “which would have been politically troublesome to say the least.” Indeed, I bet “she thinks she has enough evidence to bring charges without a grand jury indictment,” says Pat Cunningham at the Rockford Register Star. “Don’t be surprised if charges are brought before the end of the week.”

Where is Zimmerman now?
Zimmerman has been in hiding since Martin’s death became a national story. His Sanford, Fla., neighborhood, where the shooting took place, has become somewhat dangerous for Zimmerman thanks to protests demanding the 28-year-old’s arrest. Zimmerman has, however, said through his lawyers that if he is charged, he will turn himself in.

Funeral Director Says: “Trayvon Didn’t Fight With Anybody”

Even the funeral director who inspected Trayvon Martin’s body doesn’t believe George Zimmerman’s claim of self defense.

Richard Kurtz, a funeral director for Roy Mizell and Kurtz Funeral Home in Fort Lauderdale, told the Orlando Sentinel that when he heard of Zimmerman’s self-defense claim in the media, “it did not add up.”

Kurtz doesn’t believe Zimmerman’s story saying:

“I did not see any signs that would indicate to me that [Martin] was beating anybody. He just looked like a normal person that got shot.”

Kurtz said he would have expected bruising or cuts on Trayvon’s hands or body, but saw none. When he heard Zimmerman was claiming he’d been punched by Martin, “the story did not fit the situation.”

Kurtz added:

“As for his hands and knuckles, I didn’t see any evidence he had been fighting anybody.”

Zimmerman fatally shot an unarmed Trayvon in the chest at point blank range on Feb. 26 in The Retreat at Twin Lakes gated community in Sanford, Florida.

Zimmerman has been claiming self-defense from day one, has not been charged with a crime and is currently in hiding.

Zimmerman’s self-defense case is falling apart. With the release of the Zimmerman video being led into the Sanford police station showing no signs of abuse, and now the funeral director saying that Trayvon had no signs of bruising or cuts, he will be arrested. #HoodiesUp

911 Call: Trayvon Martin cried for help before gunshott

This is truly a sad, sad, story.

After repeated calls for the release of the 911 audio in the shooting death of 17-year-old Trayvon Martin, the Sanford police department finally released the audio on Friday.

Trayvon’s parents, Tracy Martin and Sybrina Fulton of Miami Gardens, arrived at Sanford City Hall to hear the tapes.

Martin broke down and and “cried like a baby,” when he heard his son pleading for his life on one of the audio tapes.

“You hear a shot, a clear shot, then you hear a 17-year-old boy begging for his life,” said Natalie Jackson, one of the family’s attorneys. “Then you hear a second shot.”

The first shot can be heard in the distance — “a warning shot,” said attorney Ben Crump. The second shot is much closer.

“It is shocking when you hear these 911 tapes,” said Crump. “It was far worse than they thought it was going to be.”

In all, the Sanford police released 8 audio tapes — 7 calls placed to 911 by nervous witnesses, and one call from the shooter, 28-year-old neighborhood watch volunteer George Zimmerman, who claimed he killed Trayvon in self-defense.

“This is an insult to this family,” attorney Natalie Jackson said. “This was not self-defense, this was not manslaughter, this was murder.”

“How can you claim self-defense and you are the aggressor?,” said Trayvon’s distraught father.

 

Tracy Martin had taken Trayvon to visit a friend who lived in a gated community in Sanford, Florida. Trayvon later left the house to walk to a nearby convenience store to buy a bag of Skittles and a can of ice tea. On his way back, he caught the attention of Zimmerman, who was cruising the neighborhood in his SUV.

Zimmerman called 911 to report a “suspicious person” inside The Retreat at Twin Lakes gated community, about 20 miles north of Orlando.

“This guy looks like he’s up to no good, or he’s on drugs or something,”Zimmerman tells the 911 operator. “It’s raining and he’s just walking around looking at houses,” says Zimmerman. The call was one of 46 calls to 911 made by Zimmerman in the past to report suspicious persons.

“He’s just staring, looking at all the houses. Now he’s coming toward me. He’s got his hand in his waistband. Something’s wrong with him,” says Zimmerman in a calm voice.

The 911 dispatcher asked Zimmerman to describe the man’s race and age. “He’s a black male… late teens,” Zimmerman responds.

Zimmerman described Martin as wearing a hoodie and sweatpants or jeans. He continues: “He’s coming to check me out. He’s got something in his hands. I don’t know what his deal is. Can we get an officer over here?”

“These assholes always get away,” he tells the 911 operator. “Shit, he’s running,”Zimmerman says calmly.

The dispatcher told Zimmerman that he was sending an officer.

[A car door slams shut]

“Are you following him?” the dispatcher asks.

“Yeah,” Zimmerman responds.

“Okay. We don’t need you to do that,” the dispatcher says.

“Okay,” Zimmerman replies.

But Zimmerman followed Trayvon anyway. Moments later, a rash of emergency calls placed to 911 from inside the community described a scuffle, cries for help and a gunshot.

But until Friday, Trayvon’s parents and the public were told that the person crying for help was the 200 pound Zimmerman.

In one of the audio tapes, a frightened voice cries out for help and pleading “No! No!” and then wailing, before a gunshot ends the cries.

Mary Cutcher, 31, whose back door was steps away from where Trayvon was shot, said she heard a boy crying, then a gunshot, then the crying stopped.

“I heard someone crying – not boo-hoo crying, but scared or terrified or hurt maybe,” said Cutcher. “To me, it was a child.”

Crutcher and her roommate said they rushed outside to see Zimmerman standing over Trayvon, with one foot on either side of Trayvon’s body. In one hand, Zimmerman held a .9 mm handgun, his other hand was on Trayvon, who was face down in the grass.

Crutcher’s roommate said she asked Zimmerman 3 times what was going on. He told her to call 911. Then he raised both hands over his head in the universal sign of ‘Oh man, I did something bad.’

Police arrived on the scene in minutes. Trayvon’s body was bagged and taken to the morgue, where he was tagged as a John Doe. No one contacted Trayvon’s family even though police had Trayvon’s cell phone in their possession.

Zimmerman was taken in for questioning and released. No charges were filed. Sanford Police Chief Bill Lee said Zimmerman was released because he had a “squeaky clean” record.

But if Lee had actually checked that record, he would have known that Zimmerman was arrested in 2005 for battery on a police officer and resisting arrest. Strangely, all charges against Zimmerman were dropped in that case.

On Feb. 27 — the day after Trayvon was murdered — Tracy Martin called 911 to report his son missing. Police asked him to describe his son. Later, police showed up at the house where Martin was staying. They brought with them a photograph of Trayvon lying in the morgue. The teenager had blood coming out of his mouth.

That’s how a father found out his oldest son was dead.
